The MOOG Labor Law Team is at your side to provide expert advice on individual and collective Labor Law in Darmstadt, Dresden and Freiberg – in German and in English.

We specialize in advising employers and have extensive experience and a clear commitment to changing perspectives. With currently six lawyers specializing in Labor Law, we provide key advice to small, medium-sized, and large businesses and companies, with and without employee representatives, as well as managing directors, board members and senior executives.

Thanks to our specialized advice to employee representatives in the rail transport sector, we are also very familiar with the perspectives of employees, works councils (called “Betriebsrat” or – dependent on the level in the company and the legal subject - “Gesamtbetriebsrat” and “Konzernbetriebsrat”) and representatives for disabled employees (called “Schwerbehindertenvertretung”). This enables us to find solutions for our employer clients that are not only legally compliant but also practical and effective in the long term.

Qualified work in Labor Law requires more than just knowledge of the law. Experience is required, as well as clear decisions and their implementation.

Our consulting practice is mainly characterized by its focus on the following topics:

  • Consulting and support for human resources departments (HR matters). You decide how intensively we can support you – we are happy to assist you right from the start of an employment relationship by drafting job advertisements or searching for personnel, during the employment relationship with contract amendments, performance reviews and, if necessary, also with warnings and the termination of employment relationships, both in and out of court.

  • Support with company closures. There are a few Labor Law issues to consider here, in particular: preparing the mass redundancy notice (called “Massenentlassungsanzeige”), communicating with authorities (especially the German Employment Agency), observing special protection against dismissal regulations (e.g., for employees on parental leave), preparing and delivering the letters of dismissal and conducting dismissal protection proceedings. We will draw up a schedule for you, because timing is crucial here. Is there a works council to involve? Then let's talk about a social plan (called “Sozialplan”) and a reconciliation of interests (called “Interessenausgleich”). We will be happy to support you in the negotiations with our many years of experience.

  • Drafting and negotiating works agreements and regulatory agreements between employers and works councils. We see ourselves as consultants who know that company regulations usually require two signatures – benefit from our experience from both perspectives.
  • Implementation requirements due to new national laws, national or European case law? We will show you recommended courses of action and conduct training courses, e.g., on the Pay Transparency Directive.

  • General Equal Treatment Act, discrimination, data protection, pay requirements, works council elections, cooperation with employee representatives – we make companies and their employees fit for dealing with these issues through individual training courses, at your premises, at our law firm, or online. Please feel free to contact us.

  • Drafting of Labor Law contracts and templates, from classic employment contracts to training agreements and references. We are also happy to assist with contract management. So that you always have access to the latest templates.

  • Last but not least – advice and support in (employee) data protection (called “Beschäftigtendatenschutz”).

For comprehensive management consulting, we combine our expertise in Labor Law with the competence of a specialized team in Corporate Law – especially in M&A practice.

In addition, our in-depth knowledge of Social Security Law—from status determination procedures to support with tax audits—enables us to offer you comprehensive concepts, which can also be accompanied by our experienced colleagues in payroll accounting and tax. This results in long-term concepts that benefit both companies and their employees.
